Terms of Use

These Terms of Use (“Terms”) govern your use of the Fluence iOS app and the fluenceapp.net website (together, the “Service”), operated by Fluence. By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Fluence. Fluence is currently invite-only. You are responsible for the activity on your account and for keeping your login (tied to your phone number) secure. Provide accurate information and keep it current.

Acceptable use

You agree not to misuse the Service. Among other things, don’t: post unlawful, harmful, hateful, harassing, deceptive, or infringing content; impersonate others or misrepresent your identity; spam, scrape, or reverse-engineer the Service; attempt to access accounts or data that aren’t yours; or use Fluence to break the law. We may remove content and suspend or terminate accounts that violate these Terms.

Your content

You own the content you create. By posting it, you grant Fluence a non-exclusive, worldwide, royalty-free license to host, store, display, and share that content as needed to operate the Service and deliver it to the audiences you choose. You’re responsible for the content you post and confirm you have the rights to share it.

Recommendations are not professional advice

Recommendations on Fluence — including those synthesized by Trace, our AI agent — reflect the opinions of people in your network and automated processing. They are provided for general information only, may be inaccurate or incomplete, and are not professional, financial, medical, or legal advice. You are responsible for your own decisions.

Verification and subscriptions

What verification is. Fluence is free to use. Identity verification is an optional paid feature that confirms a real, unique person is behind your account and unlocks the ability to reach the Universe, meaning people beyond your own circle. Verification confirms identity only. It is not a background check, and it is not an endorsement by Fluence of anyone’s honesty, taste, judgment, or recommendations.

How the check is performed. The identity check is carried out by Stripe Identity. You may be asked to provide a government-issued ID and a selfie. Stripe processes that information under its own terms and privacy policy. See our Privacy Policy for how this is handled.

Price. Verification is an auto-renewing subscription priced at $4.99 per month or $49.99 per year (USD). Prices may vary by region, and the current price is always shown in the app before you confirm a purchase.

Payment through Apple. All payments are processed by Apple. Payment is charged to your Apple Account when you confirm the purchase.

Automatic renewal. Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the price listed above for the plan you chose.

Managing and canceling. You can cancel at any time. Manage your subscription and turn off auto-renewal in your Apple Account settings (on iPhone: Settings, then your name, then Subscriptions). Canceling stops future charges. Your verification remains active through the end of the period you have already paid for.

Refunds. Because Apple processes these purchases, refunds are handled by Apple under its policies and must be requested from Apple, not from Fluence.

Changes to pricing. We may change subscription pricing or what verification includes. We will give reasonable notice of changes, and they will not affect a period you have already paid for.

Third-party services

The Service integrates third-party services such as Stripe, Google, and Apple. Your use of those services is governed by their own terms and privacy policies. The Service is also subject to Apple’s App Store Terms of Service.

Intellectual property

The Fluence name, logo, software, and content (other than user content) belong to Fluence and are protected by law. We grant you a limited, personal, non-transferable license to use the app; please don’t copy, modify, or distribute it without permission.

Disclaimers and limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Fluence will not be liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us (if any) in the 12 months before the claim.

Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or to protect the Service and its users.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Please read this carefully: except where prohibited by law, you and Fluence agree to resolve any dispute arising out of or relating to the Service or these Terms through binding individual arbitration rather than in court, and both waive any right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us. Either party may still bring an individual claim in small-claims court. This clause and the governing state/venue must be reviewed and finalized by your attorney before you rely on it.

Changes

We may update these Terms from time to time. If we make material changes, we’ll provide reasonable notice and update the date above. Continued use after an update means you accept the revised Terms.
